DISQUALIFICATION FROM EMPLOYMENT
NOTE: The policy below has been updated based on a Commonwealth Court decision in December 2015 which invalidated the list of prohibitive offenses under the Older Adult Protective Services Act. There is currently no list of offenses that provide a lifetime employment ban and no prohibition on hiring someone with a conviction. Until the Act is fixed via legislation, (LoveMeHomeCare, LLC) will follow the guidance outlined below.
PROCEDURES:
- All (LoveMeHomeCare, LLC) locations must obtain all required criminal background checks on all employed individuals, including, direct care workers, office/administrative staff, and other applicable staff.
- All applicants must complete and sign an authorization and consent for Background Checks during the application process.
- There are up to three (3) required background checks:
- PA STATE POLICE CRIMINAL BACKGROUND CHECK
- DEPARTMENT OF AGING or DEPARTMENT OF HUMAN SERVICES FBI BACKGROUND CHECK
- CHILD LINE VERIFICATION
- All applicants must undergo a state police criminal background check

- If an applicant has been a resident of Pennsylvania for less than 2 years or is currently a resident of another state, the applicant must undergo an FBI check through the Department of Aging as part of the Older Adult Protective Services Act. This is in addition to the state police check.
FBI Fingerprint-Background:
- The branch may request an applicant to furnish proof of residency through submission of any one of the following documents:
- Motor vehicle records, such as a valid driver’s license or a state-issued identification.
- Housing records such as mortgage records or rent receipts.
- Public Utility records and receipts, such as electric bills.
- Local tax records.
- A completed and signed, federal, state or local income tax return with the applicants name and address pre-printed on it.
- Employment records, including records of unemployment compensation.
- If an employee is serving a client under the age of 18 or serving a client in a home where someone under the age of 18 resides, the employee must have a Department of Human Services (DHS) FBI check AND ChildLine check completed. This is in addition to the state police check.
